These Terms & Conditions (“Terms”) govern your access to and use of this website (the “Site”), and any related communications, services, tools, and content provided by BRICHAUS GROUP, INC., a California corporation, doing business as BRICHAUS PROPERTIES (“Brichaus,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Nothing on this Site constitutes an offer to provide real estate brokerage or property management services in any jurisdiction where Brichaus is not properly licensed or authorized.


2. Scope of Services

Brichaus provides professional real estate brokerage and property management services, which may include leasing, marketing, rent collection, maintenance coordination, accounting and reporting, sales representation, and related advisory services.

All services are governed exclusively by separate written agreements (including brokerage and property management agreements). Information provided on this Site is for general informational purposes only and does not create or modify any contractual relationship.


3. No Agency or Client Relationship Created by Website Use

Use of this Site, submission of forms, requests for information, emails, text messages, or phone communications does not create a broker‑client, property management, fiduciary, or agency relationship. Any such relationship arises only upon execution of a written agreement signed by both parties.


4. Informational Nature of Content

Content on this Site is provided for general informational purposes only. Real estate conditions, regulations, pricing, availability, and market data change frequently. Brichaus makes no representation or warranty that Site content is complete, current, or applicable to your specific circumstances.

Nothing on this Site constitutes legal, tax, accounting, or investment advice.


5. Advertising & Regulatory Compliance

Brichaus endeavors to ensure that all advertising and public‑facing communications are accurate, non‑misleading, and compliant with applicable real estate laws and regulations.

Where applicable:

  • Advertising in California is intended to comply with California Department of Real Estate standards.

  • Advertising in Arkansas is conducted under the supervision of the Principal Broker and includes the firm name and contact information as required by the Arkansas Real Estate Commission.


6. Electronic Communications: Purpose‑Based Consent Framework

Brichaus communicates with individuals and entities for different purposes, and your consent is evaluated based on the purpose of the communication, not merely the method of delivery.

Communications generally fall into two categories:


(a) Transactional and Informational Communications

These communications relate directly to your inquiry, relationship, or services and may include:

  • responding to requests or questions,

  • scheduling appointments or showings,

  • providing property details or documents,

  • status updates,

  • service coordination,

  • account or relationship management.


(b) Marketing and Promotional Communications

These communications may include:

  • future property opportunities,

  • listings not directly requested,

  • market insights or educational content,

  • announcements about services or offerings,

  • other promotional outreach.

Marketing communications are separate from transactional communications and are sent only when you provide affirmative consent for that purpose.


7. Consent Collection and Communication Channels

By providing your contact information to Brichaus through this Site or other means, you acknowledge and agree as follows:


Transactional Consent

You consent to receive transactional and informational communications via phone calls, email, and text messages (SMS) related to your inquiry or services. Message frequency varies. Message and data rates may apply.

This consent allows Brichaus to communicate with you as reasonably necessary to address the purpose for which you contacted us.


Marketing Consent (Optional and Separate)

If Brichaus offers marketing or promotional communications, you will receive them only if you separately and affirmatively opt in to such communications. Consent to marketing communications is not a condition of purchasing or receiving services.


8. Text Messaging (SMS)

Transactional SMS

If you provide a mobile phone number, Brichaus may send transactional text messages related to scheduling, follow‑ups, document delivery, leasing activity, or service coordination.


Marketing SMS

If offered, marketing text messages are sent only to individuals who have provided a separate affirmative opt‑in specific to marketing SMS.


Verbal Consent Confirmation

If SMS consent is provided verbally (by phone or in person), Brichaus will send a confirmation text message requiring an immediate reply (such as “YES”) to confirm your decision. SMS consent is not treated as complete unless the confirmation reply is received.

Opt‑Out

You may opt out of SMS communications at any time by replying STOP. After opting out, you will receive a confirmation message and no further SMS messages will be sent, except where legally permitted.


9. Email Communications

Brichaus may send transactional emails related to your inquiry or services.

If marketing emails are offered, they will include:

  • clear identification of the sender,

  • a valid physical mailing address,

  • a clear and functioning opt‑out mechanism.

You may unsubscribe from marketing emails at any time using the instructions provided in the message.


10. Privacy

Your use of the Site is subject to our Privacy Policy, which explains how personal information is collected, used, shared, and protected. The Privacy Policy is incorporated into these Terms by reference.


11. Intellectual Property

All content on this Site, including text, graphics, logos, images, and design elements, is owned by or licensed to Brichaus and protected by applicable intellectual property laws. Content may not be copied, reproduced, or used for commercial purposes without prior written consent.


12. Limitation of Liability

To the maximum extent permitted by law, Brichaus shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Site or communications.


13. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law principles. Venue for any dispute arising from these Terms shall lie exclusively in Los Angeles County, California, unless otherwise required by law.


14. Modifications

Brichaus may update these Terms from time to time. Changes are effective upon posting, and continued use of the Site constitutes acceptance of the revised Terms.
